U.S. killed ’71 plan for Senkaku Islands weather station - ( J44P44NN )

Japan canceled a plan to set up a weather station on the Senkaku Islands in 1971, apparently under U.S. pressure as the two sides negotiated the 1972 return of Okinawa to Japan, declassified U.S. diplomatic documents show.

When the United States returned the China-claimed islets to Japan along with Okinawa, it wanted to avoid taking a position on the sovereignty issue, the documents indicate.

According to a cable from the U.S. Embassy in Tokyo to Washington dated Jan. 11, 1971, Japan notified the U.S. of a plan to build a weather station in the Senkakus with a view toward future use as an oil exploration base.

In response, Secretary of State William Rogers told the U.S. Embassy to “raise (the) matter” and point out that the project was “undesirable and should be postponed until after reversion,” documents dated later that month show, adding the U.S. position was to avoid a “needless increase in tension in the area,” as the project “would be interpreted by both (Taiwan and China) as raising stakes in quarrel.”

U.S. Ambassador to Japan Armin Meyer also expressed worries that Japan was trying to further confirm its sovereignty over the islets with the backing of the United States, the documents show.

Late that January, the U.S. urged Bunroku Yoshino, head of the Foreign Ministry’s old American Bureau, to postpone the project.

Yoshino replied that “his efforts to hold off (the project) would be made easier if (Washington) could find (a) way to include mention of (the) Senkakus” in the bilateral agreement on Okinawa’s reversion, they read.

In late March that year, the State Department instructed the U.S. Embassy to follow Yoshino’s suggestion in the minutes to be attached to the agreement. As a result, the two countries agreed to write down in the minutes the longitudes and latitudes of the area for reversion, thus indirectly including the Senkaku islets.

In a cable dated April 5 that year, Secretary of State Rogers said the U.S. was successful in persuading Japan to give up construction of the proposed weather station.

Tokyo and Washington concluded the agreement of Okinawa’s reversion that June.

Tokyo stocks closed flat on Thursday as the Bank of Japan upgraded its assessment of the world’s number three economy, with the yen holding firm during most of the trading session.

The benchmark Nikkei 225 index edged up 10.95 points to 14,064.82, while the Topix index of all first-section shares added 0.13%, or 1.54 points, to 1,157.84.

The slight gains came after the central bank revised upward its assessment of the Japanese economy, saying recovery was firmly underway as Tokyo works to reverse years of lumbering growth.

The greenback slipped to 99.62 yen in Thursday afternoon trading from 99.74 yen in New York Wednesday.

In New York, investors were cheered on Wednesday by data showing double-digit growth in auto sales for car giants GM, Toyota, Ford and Chrysler in August.

Adding to buying sentiment was the Federal Reserve’s Beige Book assessment of the U.S. economy, which said growth since July had been “modest to moderate”. It showed consumer spending and manufacturing was up while job creation was steady or improving.

“The U.S. Fed’s ‘beige book’ was reassuring for investors who continue to harbor doubts about the pace and quality of the economic recovery,” said SMBC Nikko Securities general manager of equities Hiroichi Nishi.

However, gains were capped by lingering concerns over the prospects of a U.S.-led military strike on Syria.

Sony Mobile unveiled a new addition to its Xperia smartphone lineup Wednesday: a device that sports a massive 20.7-megapixel camera and is capable of attaching better lenses.

The Xperia Z1, presented in Berlin two days before the annual IFA consumer electronics show there, is Sony’s attempt to leapfrog rivals such as Nokia and Samsung in the race for the phone with the best camera.

Its standout features are a high-resolution lens built into the camera, and the option of controlling detachable lenses from the phone’s 5-inch screen.

According to Sony, the lenses can also be used with other Android phones and even Apple’s iPhone.

The Z1’s camera functions are further supported by a large image sensor and dedicated apps that allow users to stream video directly onto their Facebook page, store images online and search for information about whatever their viewfinder is pointing at.

The phone, previously codenamed Honami, comes with 2.2 gigahertz processor and a waterproof aluminum case.

Sony said the Z1 will go on sale later this month.

Top court shoots down unequal inheritance rights - ( J44P44NN )

In a landmark ruling Wednesday, the Supreme Court declared unconstitutional the Civil Code clause that denies full inheritance rights to heirs born out of wedlock.

The decision will lead to a long-overdue revision of the provision, the first time it will have been changed since it took effect in 1898.

Under the current law, such heirs are entitled to inherit only half the worth of an estate handed down to their “legitimate” siblings. The Supreme Court’s decision represents a hard-fought victory for “illegitimate” children who have for years called for the eradication of the discriminatory inheritance law.

Chief Justice Hironobu Takesaki described the current situation as “unreasonable” given the increasing diversification of families in Japanese society and the changing social perception of the concept of marriage.

“Even though the system of legalized marriage has long been considered the norm in Japanese society, the fact remains children themselves have no control whatsoever over their parents’ nonlegal marital status,” Takesake said, adding it is unforgivable that these heirs have to suffer a negative impact because of this.

“It will be safe to say the social trend is now toward respecting them as an individual and securing their rights,” he said.

The unanimous decision by the top court’s Grand Bench was in response to two separate claims filed by people in Tokyo and Wakayama Prefecture who were born out of wedlock. They argued that being deprived of full inheritance rights amounts to an infringement of the principle of unconditional legal equality.

In both cases, the plaintiffs saw their claims turned down at the district and high court levels.

Media reports quoted the plaintiffs as saying during a session of the Supreme Court in July that they find it intolerable to be discriminated against due to “circumstances beyond their control.” The defendants, who held the legal status of being the “legitimate” children of deceased fathers, stressed that the Civil Code as it now stands reflects Japan’s traditional favor for legal marriage and should not be changed.

After the ruling was announced, Chief Cabinet Secretary Yoshihide Suga told reporters that the administration will submit a bill to the Diet to revise the Civil Code to reflect the Supreme Court’s decision.

“We will view the judgment of the Supreme Court with utmost seriousness,” Suga told his regularly scheduled news conference. “We will consider necessary legal measures to fully respect the meaning of the decision.”

Asked if the administration will move quickly enough to submit the bill during the extraordinary legislative session that starts next month, Suga declined comment on the timing.

The origin of the inheritance disparity dates back to 1898. After surviving the postwar reforms intact, it first underwent major scrutiny by the Supreme Court’s Grand Bench in 1995. The 15-member bench at that time found the stipulation constitutional in a vote of 10 to 5 on the grounds “its acknowledgement of half heirship for illegitimate children rather means their rights are protected.”

The decision set a precedent for similar cases in subsequent years. The provision was examined again by the court’s PettyBench five different times, but each time the five-justice panel decided it was constitutional, although sometimes by a narrow margin.

In a revisionist move, a legislative council under the Justice Ministry concluded in 1996 that inheritance rights must be made equal regardless of the situation surrounding one’s birth.

The proposal, however, was dismissed by the conservative Liberal Democratic Party, which said this might undermine the nation’s traditional family values and possibly encourage marital infidelity.

The number of illegitimate children, which in 1995 stood at 14,000, rose by 1.6 percent to 23,000 in 2011, according to a survey by the welfare ministry.

Outside the court, Mikiko Ikeda, 65, who has a relationship with a man with whom she is not legally married, excitedly hailed the historic news. A mother of two sons, Ikeda said she was truly relieved that the long-running imbroglio has been resolved while she is still alive.

“After the 1995 decision, when the provision was declared constitutional, I was severely disappointed in the Japanese judiciary’s inability to secure one of the most basic human rights for us,” Ikeda said. “So this is my dream come true.”

Patent ruling on Lilly's Alimta lung-cancer drug expected in 2014 - J44P44NN

(Reuters) - A high-stakes decision on whether to extend U.S. marketing exclusivity of Eli Lilly and Co's blockbuster Alimta lung cancer drug is not expected until next year, following a two-week trial in Indianapolis federal court.

Most industry analysts have long assumed the $2.6 billion-a-year drug will lose U.S. patent protection and face competition from cheaper generics in January 2017, with the lapse of the basic patent on the pill's chemical structure.

But Lilly argued during the trial before U.S. District Court Judge Tanya Walton Pratt that a separate "method-of-use" patent on the way Alimta is administered should protect the medicine from U.S. generics until 2022. The trial, which began August 19, ended late last week.

The so-called '209 patent covers administration of two nutrients - folic acid and vitamin B12 - to patients before they receive Alimta, to prevent side effects. Alimta's package insert label instructs doctors to administer the nutrients prior to and during use of the medicine.

The defendants in the case, Teva Pharmaceutical Industries Ltd and Fresenius SE & Co KGaA, challenged the validity of the '209 patent.

Plaintiff Lilly and the opposing generic drugmakers have requested permission to file a series of post-trial briefings that would extend past mid-December, according to an official of the Clerk of Court's office.

Pratt will then review them, along with evidence from the trial, before issuing a ruling, the official said.

Attorneys for Teva and Lilly declined to comment on the case.
